Terms and Conditions and Privacy policy

  1. Agreement Overview
     By renting a vehicle from Onyx Dreams Elite Rentals in the State of Michigan, the renter (“You”) agrees to the following Terms & Conditions and Privacy Policy. These terms are governed by Michigan law (MCL 257.1 et seq.). Violations may result in additional fees, repossession, or legal action.

     

  2. Eligibility Requirements
     You must be at least 21 years old (25+ for premium or luxury vehicles), possess a valid driver’s license, and maintain active auto insurance as required under Michigan No-Fault Insurance Law.

  3. Payment, Deposits & Fees
     Security deposits may be required. By renting a vehicle, you authorize charges for rental fees, tolls, citations, cleaning, damages, excess mileage, fuel replacement, late returns, missed payments, and applicable administrative fees. Michigan law allows recovery of actual damages and loss of use.

     

  4. Insurance & Liability (Michigan No-Fault Law)
     You must maintain Personal Injury Protection (PIP) and Property Protection Insurance (PPI) as required by Michigan law. If you decline optional insurance coverage offered by Onyx Dreams Elite Rentals, you assume full responsibility for any damage not covered by your personal insurer, including deductibles and uncovered losses. You remain financially responsible for damage to the rental vehicle regardless of fault.

  5. Prohibited Uses
     The vehicle may not be used for racing, towing, off-roading, transporting illegal goods, unapproved rideshare activity, reckless driving, or smoking/vaping. Operation while impaired by alcohol or drugs is strictly prohibited under Michigan law.

  6. Mileage, Fuel & EV Charging
     Mileage limits may apply. Excess mileage will incur additional fees. Vehicles must be returned with the same fuel or charge level provided at pickup. Premium fuel is required for designated vehicles, and receipts may be requested.

     

  7. GPS Tracking & Immobilization Devices
     Vehicles may contain GPS tracking systems, telematics, and immobilization devices as permitted under Michigan law. Tampering is prohibited. Vehicles may be disabled for non-payment, contract violations, or suspected theft.

     

  8. Accidents, Damage & Reporting Requirements
     Accidents involving injury, death, or property damage must be reported immediately in accordance with MCL 257.622. You must notify Onyx Dreams Elite Rentals immediately and file a police report when required. You are responsible for tire and wheel damage, windshield cracks, interior damage, lost keys, and uninsured damage.

  9. Cleaning & Smoking Policy
     Vehicles must be returned in clean condition. Cleaning fees range from $50–$300. A strict no-smoking policy applies. Smoke removal fees begin at $250.

  10. Late Returns & Extensions
     Late fees begin immediately after the scheduled return time. Unauthorized extensions may result in vehicle immobilization and recovery.

  11. Vehicle Condition & Inspections
     Pre- and post-rental inspections are conducted. The vehicle must be returned in the same condition as received, excluding normal wear and tear.

     

  12. Abandonment, Theft & Failure to Return
     Failure to return a vehicle within the agreed rental period may constitute vehicle embezzlement under Michigan Penal Code (MCL 750.413).

  13. Governing Law
     All disputes are governed by Michigan law and must be handled in Michigan courts.

  14. Privacy Policy – Information We Collect
     We collect personal information voluntarily provided by users, including name, email address, phone number, driver’s license information, insurance information, and details submitted through website forms, chat widgets, phone calls, or SMS communications.

     

  15. How We Use Information
     Information may be used to process rentals, respond to inquiries, provide customer support, send service-related communications, verify identity, comply with legal requirements, and send SMS communications to users who have provided proper consent.

     

  16. SMS/Text Messaging Policy
     Onyx Dreams Elite Rentals only sends SMS messages to individuals who have explicitly opted in to receive text messages.
    1. SMS Consent: Users may opt in by selecting an optional SMS consent checkbox on a website form, providing verbal consent during a phone call, or initiating contact via text message to our business number. SMS consent is not required as a condition of rental or service.
    2. Message Content: Users who opt in may receive booking confirmations, rental updates, reminders, important service notifications, and occasional promotional messages when applicable.

    3. Opt-Out
       You may opt out at any time by replying STOP or UNSUBSCRIBE to any message. After opting out, you will no longer receive SMS communications unless you opt back in.

  17. Data Sharing & Disclosure
    Information collected from customers, including mobile phone numbers obtained through opt-in SMS forms, is accessible only to authorized employees or contractors who require it to perform their duties.
    We do not share, sell, or distribute mobile contact information to third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent information is strictly limited to internal use and may only be shared with trusted service providers who support essential business operations, such as customer service, CRM systems, payment processors, and communications platforms.
    Information may only be disclosed if required by law, legal process, or in connection with a business transfer.
     
    Data Retention & Security
  18. Personal information is retained only as long as necessary for business or legal purposes. We implement reasonable administrative, technical, and physical safeguards to protect user data; however, no system can guarantee absolute security.

     

  19. Children’s Privacy
     Onyx Dreams Elite Rentals does not knowingly collect personal information from individuals under the age of 13. If such information is identified, it will be deleted.

     

  20. Cookies
     Our website may use cookies to analyze performance, improve user experience, and support advertising or tracking preferences. Users may disable cookies through their browser settings.

  21. Do Not Track
     Our website does not currently respond to browser “Do Not Track” signals.

     

  22. Policy Updates
     These Terms & Conditions and Privacy Policy may be updated periodically. Continued use of our services constitutes acceptance of any revised terms.
